Article 1: Definitions
- User: An individual who uses this application.
- Content: Text, images, audio, video, software, and other information contained within or accessible through this application.
- クローンの作成(1人分): A consumable paid item, “クローンの作成(1人分)”
- Kiroc Talk: The auto-renewing subscription service “Kiroc Talk.”
- Intellectual Property Rights: Copyrights, trademarks, patent rights, utility model rights, design rights, and other intellectual property rights (including the right to acquire or apply for registration of these rights).
Article 2: License to Use
- The Provider grants Users a non-exclusive, non-transferable, and non-sublicensable right to use this application in accordance with these Terms.
- Users may use this application solely for personal and non-commercial purposes.
Article 3: Consumable Paid Items
- Content: Users may obtain the consumable paid item “クローンの作成(1人分)” (hereinafter referred to as “the Item”) by paying the amount specified within the application. By using the Item, Users can create one clone.
- Price: The price for the Item is ¥9,200.
- Payment: Payment for the Item will be made via Apple’s in-app purchase system, and the amount will be charged to the payment method registered with the User’s Apple ID.
- Validity: The Item does not have an expiration date. However, if the User deletes their account for this application or if the Provider ceases to provide the application, the Item will become invalid.
- Refunds: Refunds for purchased Items are not permitted. However, this does not apply in cases where refunds are mandated by law.
- Price Changes: The Provider reserves the right to change the price of the Item. Users will be notified in advance of any changes via in-app notifications and email.
- Termination of Provision: The Provider reserves the right to terminate the provision of the Item for operational or other reasons. In such cases, advance notice will be provided via in-app notifications and email.
Article 4: Subscription
- Content: By subscribing to “Kiroc Talk” (hereinafter referred to as “the Plan”), Users can interact with clones without limitations.
- Price: The monthly fee for the Plan is ¥1,200.
- Payment: Payments will be processed via Apple’s in-app purchase system, and the amount will be charged to the payment method registered with the User’s Apple ID.
- Subscription Period: The subscription period for the Plan is one month. The subscription will automatically renew each month unless the User cancels it. Payment will be charged to the User’s iTunes account upon confirmation of purchase. Unless auto-renewal is turned off at least 24 hours before the end of the current period, the subscription will automatically renew. Renewal charges will be made within 24 hours before the end of the current period, and the renewal cost will be specified.
- Cancellation: Users can cancel the Plan by navigating to [Settings] on their device, accessing [Subscriptions], and selecting [Cancel Subscription] for the Plan. Even if the subscription is canceled during the subscription period, the Plan will remain available until the end of the current subscription period. Refunds for partial periods are not provided.
- Price Changes: The Provider reserves the right to change the price of the Plan. Users will be notified in advance of any changes via in-app notifications and email. Continued use of the Plan after the price change will be considered acceptance of the new price.
- Modification or Termination of Service: The Provider reserves the right to modify or terminate the Plan for operational or other reasons. Advance notice will be provided via in-app notifications and email.
Article 5: Prohibited Actions
Users are prohibited from engaging in the following actions when using this application:
- Violating laws or these Terms.
- Infringing on the rights of the Provider or third parties.
- Interfering with the operation of this application.
- Altering, reverse engineering, decompiling, or disassembling this application.
- Copying, altering, distributing, or publicly transmitting the content of this application without authorization.
- Illegally collecting, using, or disclosing personal information of other Users.
- Providing false information.
- Transmitting or writing harmful programs.
- Other actions deemed inappropriate by the Provider.
Article 6: Disclaimer
- The Provider does not guarantee the accuracy, completeness, usefulness, or safety of the content or information provided through this application.
- The Provider is not liable for any damages incurred by Users resulting from the use of this application, except in cases of willful misconduct or gross negligence by the Provider.
- The Provideris not liable for damages caused by interruption, suspension, termination, unavailability, or changes to the application, loss of data, or damage to equipment caused by the use of this application, except in cases of willful misconduct or gross negligence by the Provider.
- The Provider is not responsible for any transactions, communications, or disputes between Users and third parties or other Users related to this application.
Article 7: Intellectual Property Rights
Intellectual property rights related to this application and its content belong to the Provider or its licensors. Users may not use these rights beyond the scope of the license granted under these Terms.
Article 8: Termination of Agreement
The Provider may suspend a User’s use of the application or terminate the agreement based on these Terms without prior notice if the User violates these Terms.
Article 9: Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with Japanese law. Any disputes arising in connection with this application or these Terms will be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Article 10: Amendments to Terms of Service
The Provider may amend these Terms as necessary. Amendments will be announced within the application or on The Provider’s website. Significant changes may be communicated individually to Users. Continued use of the application after the changes indicates acceptance of the amended Terms.
